1915(b)(c) Waiver Renewal

The NC Innovations Waiver and the NC MH/DD/SAS Waiver, also collectively known as the 1915(b)(c) Waivers, provide Medicaid coverage to support people with mental health diagnoses, intellectual or developmental disabilities, and substance use disorders in North Carolina.  

The NC Department of Health and Human Services (NC DHHS) is in the process of renewing these waivers with the federal Centers for Medicare and Medicaid Services (CMS). Through the renewal process, NC DHHS revised areas of the waivers to clarify or modify services. Once approved by CMS, the waivers will operate for a five-year period.

NC DHHS Announces Temporary Waiver Extensions

On January 3, 2019, NC DHHS announced that CMS has granted a 90-day extension of North Carolina's existing 1915(b) and (c) Waivers as the revised versions of these waivers make their way through the renewal process.  CMS granted North Carolina temporary extensions for these concurrent waivers until March 29, 2019.
In this announcement, the State advises that the NC Innovations Waiver (also known as the 1915 (c) Waiver) will continue to operate at cost and utilization levels approved for the fifth (current) year of the waiver – until the new expiration date in March. The State also advises that the NC Innovations Individual Cost Limit of $135,000 per year will reset with members’ approved annual Individual Support Plans.
The announcement additionally clarifies that services with “Life of the Waiver” financial limits (such as Home Modifications, Vehicle Modifications and Assistive Technology) may not exceed those limitations until after the NC Innovations Waiver is renewed. Once the waiver is renewed, those limits will re-set.
